ClosingKey Privacy Policy

Effective Date: October 1, 2025

1. Introduction

Welcome to ClosingKey ("we," "us," "our"). We are committed to protecting your privacy. This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you use our platform and services (collectively, the "Services"). Our core service is to connect property owners with interested buyers and investors ("Users") through an anonymous, secure messaging system.

Please read this Privacy Policy carefully. If you do not agree with the terms of this policy, please do not access or use our Services.

2. Information We Collect

We collect information in a few different ways, depending on how you interact with our Services.

A. Information You Provide to Us

Registered Users (Buyers/Investors): When you create an account, we collect personal information such as your name, email address, password, and investment preferences.

Unregistered Users (Property Owners): When you choose to initiate a conversation with a buyer, we collect your phone number via our secure webpage. This is necessary to facilitate the text message conversation.

Message Content: We collect the content of the messages you send and receive through our anonymous messaging service.

B. Information We Collect Automatically

Log and Usage Data: Like most web-based services, we automatically collect information when you access and use our Services. This includes your IP address, browser type, operating system, pages viewed, and the dates/times of your access.

Cookies and Similar Technologies: We may use cookies to help customize the Service and improve your experience. You can manage your cookie preferences through your browser settings.

3. How We Use Your Information

We use the information we collect for the following purposes:

  • To Provide and Manage the Service: To create and manage user accounts, facilitate connections between buyers and property owners, and operate our core messaging functionality.
  • To Operate the Anonymous Messaging System: Your phone number is used exclusively to establish a proxied, anonymous communication channel with another user. We will never display your real phone number to another user.
  • To Improve Our Services: To understand how our users interact with the platform so we can enhance functionality and user experience.
  • To Maintain Security and Prevent Fraud: To protect the integrity of our platform and our users.
  • To Comply with Legal Obligations: To cooperate with law enforcement and regulatory inquiries as required by law.

4. How We Share Your Information

Your privacy is paramount. We only share information under the following limited circumstances.

With Other Users (Anonymously)

The fundamental principle of our service is anonymity. When you communicate with another user, we only share your message content through a temporary, proxied phone number. Your real name (unless you include it in a message), email address, and phone number are never shared with the other user in the conversation.

With Third-Party Service Providers

We use third-party vendors to help us operate our Services. Our primary partner for messaging is Twilio.

Twilio: To facilitate our anonymous text messaging service, we share the phone numbers of both conversation participants with Twilio. Twilio is contractually obligated to handle this data securely and confidentially. Message content also passes through Twilio's platform. You can review their privacy policy at https://www.twilio.com/legal/privacy.

We may also use other vendors for services like cloud hosting (e.g., AWS, Google Cloud) and analytics. These vendors only have access to the information necessary to perform their functions.

No Sharing for Marketing Purposes

We do not sell your personal information. Furthermore, no mobile information, including your name, phone number, or message content, will be shared with or sold to third parties or affiliates for their own marketing or promotional purposes. All information is shared only for the purpose of providing and operating the Services as described in this policy.

For Legal Reasons and to Protect Our Rights

We may disclose your information if required to do so by law or in the good faith belief that such action is necessary to (i) comply with a legal obligation, (ii) protect and defend our rights or property, (iii) prevent or investigate possible wrongdoing in connection with the Services, or (iv) protect the personal safety of Users or the public.

Business Transfers

In the event of a merger, acquisition, or sale of all or a portion of our assets, your information may be transferred as part of that transaction. We will notify you via a prominent notice on our site of any change in ownership.

5. Your Rights and Choices

You have certain rights regarding the personal information we hold about you.

  • Accessing and Updating Your Information: Registered users can review and update their account information at any time by logging into their account.
  • Opting Out of SMS/Text Messages: You can opt out of a specific text message conversation at any time by replying with the keyword STOP. This will end that specific communication thread. To opt out of all communications, please contact us directly.
  • Account Deletion: Registered users may delete their account at any time. Upon deletion, we will remove your personal information from our active databases, though we may retain some information for a period for backups, fraud prevention, or legal compliance.
  • Cookie Controls: You can set your browser to refuse all or some browser cookies.

6. Data Security

We implement a variety of administrative, technical, and physical security measures to protect the security of your personal information. We use SSL encryption for data in transit, and we restrict access to personal information to our employees and third-party vendors who need to know that information to process it for us. However, please be aware that despite our best efforts, no security measures are perfect or impenetrable.

7. Children's Privacy

Our Services are not directed to individuals under the age of 18, and we do not knowingly collect personal information from children under 18. If we become aware that we have collected such information, we will take steps to delete it.

8. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. We will notify you of any changes by posting the new policy on this page and updating the "Effective Date" at the top. We encourage you to review this Privacy Policy periodically for any changes.
